Statement | Phnom Penh Court Sentences Independent Radio Station Owner to 20 Years

We, the undersigned civil society organizations, condemn the Phnom Penh Municipal Court’s shocking conviction of independent radio station owner Mam Sonando today, and the draconian 20-year sentence that he received. At age 70, Sonando is likely to die in prison if he serves his full term.
Sonando, the owner of Beehive radio, was arrested on July 12 on charges that he masterminded a so-called “secessionist movement” in Kratie. Several co-defendants were charged with organizing the movement on the ground. They were all convicted as well, though two of the previously identified “ringleaders” had their sentences suspended, echoing the Prime Minister’s public statement that those who confess would be spared punishment.

In the past three days, the Phnom Penh Municipal Court has ordered the unjustified pre-trial detention of two female land rights advocates in unrelated cases. These two incidents are the latest in a long string of incidents in which the courts have been wielded as a weapon to silence victimized communities.
The two arrested activists have long been struggling to advocate on behalf of powerless residents involved in land disputes with some of Cambodia’s most well-connected and powerful business tycoons.

The Cambodian government has quietly released a draft agricultural land law could be used as legal cover for land-grabbing and natural resource exploitation.
As increasing violence and human rights abuses related to land conflicts throughout the country continue to race towards a crisis point, the introduction of this draft law could not come at a worse time. The law - officially titled the Law on the Management and Use of Agricultural Land - would have grave implications for private landholders, taking away their ability to make fundamental land use decisions on their own property under threat of criminal prosecution.

The undersigned organizations are deeply disturbed by independent radio station director Mam Sonando's arrest on Sunday, July 15, 2012, and call for his immediate release. Mr. Sonando, who holds both Cambodian and French citizenship, is the owner of Beehive Radio, which is among the few independent radio stations in Cambodia. Sonando is also the founder and president of the Democrat Association.

The number of inmates incarcerated for drug offenses increased by 163% in 2011, but the Cambodian prison population grew only modestly overall, according to
a new LICADHO report.
The General Department of Prisons (GDP) reported that there were 2,747 inmates held on drug-related charges in November 2011, up from 1,046 in November 2010. The surge came during a yearlong drug crackdown that resulted in nearly 1,000 arrests.

Outside the Lines, a new report by local urban NGO Sahmakum Teang Tnaut (STT), proposes a viable and practical solution for the households excluded from the 12.44Ha concession in Boeung Kak. The report shows that the households arbitrarily excluded from the 12.44Ha concession could easily be included in the concession zone, by allowing some households to move inside the area as well as through a small revision of the concession’s boundaries.
We, the undersigned groups, call on the Municipality of Phnom Penh and the Royal Government of Cambodia to heed the community’s calls to physically demarcate the boundaries of the 12.44Ha concession and to enter negotiations with the community to include the excluded households.

We, Cambodian and International civil society organizations represented in this statement, condemn the use of armed force and escalating violence against citizens peacefully defending their land, labor and natural resources rights. We are referring to not only the events earlier last week on 22nd May, when dozens of peaceful Boeung Kak Lake (BKL) protesters were violently dispersed and two days later when fifteen (fourteen women and one male) BKL residents were sent to Prey Sar prison and charged and convicted of unfounded criminal offenses, but also the recent shooting incidents-the killings of environmental activist Chut Wutty in Koh Kong province and 14-year old girl Heng Chantha in Kratie province, and the shooting of three young women protesting for better working conditions in Svay Rieng province. These incidents are particularly disturbing because they indicate an increasing readiness on the part of security and military forces to use lethal force against civilians.

LICADHO and its partner NGOs will mark International Children's Day today by distributing food and materials to children and pregnant women in 14 of Cambodia's prisons.
LICADHO has also organized special Children's Day events at Correctional Center 2 ("CC2"), Kandal provincial prison, and Siem Reap provincial prison. The events will include games, prizes and guest speakers who will discuss children's issues.

LICADHO condemns the reckless and bloody attack on a Kratie village by soldiers and police on Wednesday, which resulted in the shooting death of a 14-year-old girl.
The authorities must conduct an immediate investigation into the shooting, and prosecute those responsible to the fullest extent of the law.
The military-style operation saw hundreds of soldiers, military police and police lock down the village a day prior to the shooting. The next morning, the armed forces, aided by a helicopter, stormed the village in Kampong Domrey commune. Authorities claim the operation was organized solely to arrest three ringleaders in an alleged "secession" plot. Villagers, meanwhile, say that the attack was motivated by an ongoing land dispute with Casotim, a firm that claims villagers are infringing on their land concession.

New government regulations take the important step of banning the export of prison-made goods, but fall short of fully protecting inmates from exploitation by private firms, according to a new briefing from LICADHO.
LICADHO believes that the export ban is an important step in protecting Cambodia's reputation as a reputable supplier in the international garment industry. But the prakas fails to fully ban private firms from using prison labor for domestic production, which leaves prisoners open to systematic rights violations.

Nearly 800 inmates detained in Cambodia's provinces are at risk of being deprived of their fundamental appeal rights due to a lack of inmate transport options, according to a new report from LICADHO.
Cambodian law requires the presence of the accused at appeal hearings, but few provincial inmates are able to appear due to lack of transportation funding and poor organization between the prisons and courts. The nation's lone Court of Appeal is located in Phnom Penh.

The organisations also call attention to the eviction notice served to families along the railway tracks in Poi Pet - should the notice be acted upon, this would amount to forced eviction in the ADB and AusAID funded railways rehabilitation project.
Statement | All Talk, Little Action: Two Years After UN Human Rights Review, Cambodia Continues to Ignore Key Recommendations

This week marks the two year anniversary of the UN Human Rights Council's adoption of Cambodia's Universal Period Review (UPR) outcome report. Remarkably, during the UPR, Cambodia accepted all 91 recommendations presented by dozens of countries on a wide range of human rights issues. Since then, the government has tasked the Cambodian Human Rights Committee (CHRC) with coordinating Cambodia's response - a process which has amounted to little, if any, meaningful implementation of the recommendations by relevant state institutions.
After two years of ignoring the substance of the majority of those recommendations, and two years of an ever deteriorating human rights landscape, the Cambodian government owes the UPR delegates and Working Group, and most of all its own citizens, an explanation.
